SCELP's attorneys have reported that our appeal is on target after completion of a two day trial in our Wedgefield II case on August 25-26, 2008.
The appeal, filed on behalf of the League of Women Voters of Georgetown and the Coastal Conservation League, challenges a permit and certifications authorizing the placement of dredged spoil materials in 13 acres of wetlands adjacent to the Black River.
DHEC denied the same permit and certifications in 2004 and initially rejected Wedgefield Plantation Association's re-application in 2007 because it contained "no new information." Wedgefield then asked two State Senators to help promote the project to DHEC. After the Senators intervened, DHEC did a 180-degree turn and issued the permit and certifications for using the same wetlands for spoil disposal. An Administrative Law Judge now has the case under advisement and will make a ruling after we receive the court reporter's transcript and submit written arguments.
